Health & Safety Executive (HSE) Guide.

The Health and Safety Executive (HSE) does not tell you precisely what you can and cannot do at your workplace or in your business, what it does is give guidelines and then pass the buck over to you. The keyword in their approach is “appropriate” and this means that you, as an employer, are tasked to take or appoint someone to make appropriate decisions. That person, be it you or someone else has to be “competent” in making those appropriate decisions. If you appoint us as your “competent” person we can advise and keep you on track.

What Does Your Employer Legally Have To do?

Your employer has a “duty of care” to ensure, as far as is reasonably practicable, your health, safety and welfare whilst you are at work. This means that they must take all reasonable steps to prevent you from being harmed or made ill while you are working for them, including conducting thorough health and safety risk assessments. Your employer should consult with employees on health and safety matters.

Employers Duty

  • Appoint a competent person

    Your employer must appoint one or more “competent persons” to help them comply with health and safety law. A competent person should have the necessary skills, knowledge and experience to be able to spot potential health and safety hazards in your workplace and put in place measures to control the risks.

  • If employing five or more staff, produce health and safety policies and procedures

    If your employer employs five or more staff, they must prepare written health and safety policies and procedures. These must be suitable for your workplace and cover the health and safety arrangements that are in place.

  • Display the health and safety at work poster

    Your employer must display the health and safety at work poster in a prominent position in your workplace where you can see it. The poster gives basic health and safety information.

  • Carry out risk assessments

    Your employer must carry out risk assessments to identify what could cause harm in your workplace and decide whether they are taking reasonable steps to prevent that harm. They should involve you in this process.

  • Hold open health and safety consultations with your employees

    Your employer should hold regular health and safety consultations with employees to discuss health and safety concerns in your workplace. These could be informal discussions or more formal meetings.

  • Provide first aid facilities

    Your employer must provide appropriate first-aid facilities and make sure that at least one person has received first-aid training to cover the needs of your workplace.

  • Provide welfare facilities

    Your employer should provide welfare facilities such as toilets, washing facilities and a place to eat lunch if you are working away from home or are on a construction site.

  • Free of charge, give your staff the health and safety training they need to do their job

    Your employer should provide health and safety training to employees free of charge. The training you receive should be appropriate for your job, and must be given:

    • Before you start work
    • Whenever health and safety arrangements change in a way that affects your job
    • When you are first promoted or move into a job with new health and safety conditions.
